Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

Description of Service

SOSVine is a mobile application designed to help vineyard owners and managers monitor disease and pest risks, track weather threats, log treatments, and share community observations. The App provides data-driven risk assessments based on real-time and historical environmental data and community alerts. SOSVine is available as a free service with optional premium subscription features for advanced analysis.

User Accounts

• You must be at least 16 years old to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information when creating your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Subscriptions & In-App Purchases

SOSVine offers both free and premium tiers. The free tier includes core functionality: monitoring one vineyard, viewing all disease and pest risks at a glance, weather alerts, community alerts, and the interactive map. Premium features provide advanced analysis and are available through a paid subscription.

• Premium subscriptions are available on a weekly, monthly, annual, or lifetime basis
• Payment is charged to your Apple App Store or Google Play Store account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
• You can manage and cancel your subscription at any time through your device's App Store or Google Play Store settings — not through the App itself
• No refund will be provided for the unused portion of any subscription period
• Refunds are handled exclusively by Apple or Google in accordance with their respective refund policies
• We reserve the right to change subscription pricing with reasonable advance notice; price changes will not affect active subscription periods
• If a free trial is offered, any unused portion of the trial will be forfeited when you purchase a subscription

Promotional Codes

• Promotional codes may be offered at our discretion and are subject to specific terms communicated at the time of issuance
• Promo codes are non-transferable, may not be combined with other offers, and have no cash value
• We reserve the right to revoke promotional codes at any time if we detect abuse, fraud, or violation of these Terms

Community Alerts

• You are responsible for the accuracy of any community alerts you submit
• Alerts must reflect genuine observations from your vineyard or surrounding area
• Deliberately submitting false or misleading alerts is prohibited
• Abuse of the alert system, including spam or malicious content, may result in account suspension or termination
• By submitting alerts, you grant SOSVine the right to display them anonymously to other users

User Content

• You retain ownership of any content you submit through the App, including photos, notes, and alert data
• By submitting content, you grant SOSVine a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute such content for the purpose of operating and improving the App
• You represent that you have all necessary rights to the content you submit and that it does not infringe on any third party's rights
• We reserve the right to remove any content that violates these Terms, is inappropriate, or that we deem harmful to the App or its users

Prohibited Conduct

• You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• You may not use automated systems, bots, scrapers, or similar tools to access or interact with the App
• You may not attempt to circumvent, disable, or interfere with premium feature restrictions or payment mechanisms
• You may not interfere with or disrupt the integrity or performance of the App or its servers
• You may not impersonate any person or entity, or falsely claim an affiliation with any person or entity
• You may not use the App for any unlawful purpose or in violation of any applicable local, national, or international law
• You may not upload malicious code, viruses, or any harmful material through the App

Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, algorithms, and software — are the exclusive property of SOSVine and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Disclaimer — Agricultural Advice

Limitation of Liability

• SOSVine is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied
• We do not guarantee the accuracy, completeness, or timeliness of risk assessments, weather data, or community alerts
• In no event shall SOSVine be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability shall not exceed the amount you have paid for the App in the preceding 12 months, or €50, whichever is greater

Indemnification

You agree to indemnify, defend, and hold harmless SOSVine, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any content you submit through the App.

Service Availability & Modifications

• The App is provided on an "as-available" basis. We do not guarantee uninterrupted or error-free operation
• We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice
• Features, including premium features, may change over time. We will make reasonable efforts to notify users of significant changes
• Scheduled maintenance or updates may temporarily affect the availability of certain features
• We are not liable for any loss or inconvenience caused by the unavailability of the App or any of its features

Third-Party Services

The App relies on third-party services, including but not limited to weather data providers, cloud infrastructure, push notification services, and payment processors. We are not responsible for the availability, accuracy, or performance of these third-party services. Interruptions or errors from third-party services may affect the App's functionality, and SOSVine shall not be held liable for such interruptions.

App Permissions

The App may request access to the following device features with your explicit permission:

• Location Services — to position your vineyards and display nearby alerts
• Camera & Photo Library — to attach photos to community alerts
• Push Notifications — to deliver alerts about risks, weather, and community activity

You can manage these permissions at any time through your device settings.

Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in behavior that harms the App, its users, or the integrity of the community. You may delete your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall remain in effect, including but not limited to intellectual property, limitation of liability, indemnification, and governing law.

Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the App, you agree to first attempt to resolve the dispute informally by contacting us at contact@sosvine.com. We will make good-faith efforts to resolve any dispute within 30 days. If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts specified in the Governing Law section below.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden. This does not affect your statutory rights as a consumer under the laws of your country of residence within the EU.

Force Majeure

SOSVine shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, power failures, internet or telecommunications failures, cyberattacks, pandemics, or disruptions to third-party services we rely upon.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SOSVine regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.

Waiver

The failure of SOSVine to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision shall only be effective if in writing and signed by SOSVine.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. SOSVine may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Third-Party App Store Terms

If you access the App through the Apple App Store or Google Play Store, you acknowledge and agree to the following:

• These Terms are between you and SOSVine only, not with Apple Inc. ("Apple") or Google LLC ("Google")
• Apple and Google have no obligation to provide any maintenance, support, or warranty for the App
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple or Google for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple and Google have no other warranty obligation with respect to the App
• Apple and Google are not responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance, or intellectual property infringement
• In the event of any third-party claim that the App infringes a third party's intellectual property rights, SOSVine, not Apple or Google, shall be solely responsible for the investigation, defense, and resolution of such claim
• Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as third-party beneficiaries
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or via email at least 14 days before the changes take effect. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and delete your account.
